Kateri Studios - Terms & Conditions
A legal disclaimer

The information provided on this page is intended to explain the terms under which Kateri Studios provides its products and services.
These Terms & Conditions are intended for general use and do not replace professional legal advice. Kateri Studios is a UK-based business, and applicable consumer protection and other laws may apply to purchases and services provided through this website.
Nothing in these Terms & Conditions is intended to remove or restrict any legal rights that you have as a consumer.
By purchasing from Kateri Studios or using our alteration services, you agree to the Terms & Conditions set out below.

Terms & Conditions – the basics

These Terms & Conditions ("Terms") apply to all purchases of products and bookings for alteration services made through Kateri Studios.
In these Terms, "Kateri Studios", "we", "us", and "our" refer to Kateri Studios. "You" and "your" refers to the customer purchasing our products or using our services.
Our products are handmade and may therefore have small variations in appearance, stitching, fabric, colour, texture, or finish. These characteristics are part of the handmade nature of our products and do not necessarily indicate a fault.
We aim to provide accurate photographs, descriptions, measurements, and information for all products and services. Colours may appear slightly different depending on your screen or device.

Handmade products

Each handmade product is created with care by Kateri Studios.
Because our products are handmade, no two pieces may be exactly identical. Minor differences in stitching, placement, texture, pattern, or finish may occur.
Where a product is made specifically to your requirements, measurements, specifications, or personalisation, this will be treated as a customised or bespoke order where applicable.
We will make reasonable efforts to ensure that handmade products match their description and agreed specifications.
Your statutory consumer rights are not affected by these Terms.

Ordering and payment

When placing an order through our website, you are responsible for providing accurate information, including your name, contact details, delivery address, measurements and any other information required to complete your order.
Please check your order carefully before completing your purchase.
Orders will only be accepted once payment has been successfully received, unless we have agreed otherwise with you.
Prices will be displayed on our website at the time of purchase. We reserve the right to correct genuine pricing or description errors.
Where an order has already been accepted and there is an error in the advertised price, we will contact you to discuss the issue before proceeding where appropriate.
Custom and bespoke orders
Some Kateri Studios products may be made or altered specifically for you.
This may include products that are:
-
Made to your measurements.
-
Made to your requested specifications.
-
Personalised.
-
Altered specifically to your requirements.
-
Created using materials, colours, designs, or details selected by you.
Because these items are created specifically for you, cancellation and return rights may differ from those applying to standard, non-customised products.
Where applicable, we will explain any restrictions on cancellation or returns before you place your order.
Nothing in this section affects your statutory rights if the product is faulty, not as described, or otherwise does not meet the requirements imposed by applicable consumer law.

Alteration services

Kateri Studios offers clothing and garment alteration services.
Before carrying out alterations, we may discuss with you:
-
The alterations you require.
-
Your measurements.
-
The desired finished fit.
-
The material and construction of the garment.
-
Any limitations or risks associated with the alteration.
-
The estimated price and completion time.
We will carry out alteration services with reasonable care and skill.
Some garments may be unsuitable for particular alterations because of their fabric, construction, age, condition, embellishments, previous alterations, or other characteristics.
If we believe an alteration may carry a significant risk of damage or may not achieve the requested result, we may discuss this with you before proceeding.

Customer-supplied garments

Where you provide your own garment for alteration, you confirm that you have the right to provide the garment to us for alteration.
You should tell us about any known damage, previous alterations, stains, weaknesses, loose seams, delicate materials, or other issues with the garment before work begins.
We will take reasonable care of customer-supplied garments while they are in our possession.
However, some garments may have pre-existing weaknesses or materials that cannot safely withstand alteration. Where we identify a reasonable risk, we may discuss this with you before continuing.
We cannot guarantee that an alteration will produce a particular result where the garment's material, construction, condition, design, or previous alterations limits what can safely be achieved.

Measurements and fitting

Where an alteration or custom item depends on measurements supplied by you, you are responsible for providing accurate measurements unless measurements are taken by Kateri Studios.
If you provide incorrect measurements, we may not be able to guarantee the intended fit.
Where a fitting or measurement appointment is required, you are responsible for attending at the agreed time and providing any information reasonably required to complete the work.

Fittings and approvals

For certain alteration or bespoke services, we may require one or more fittings.
You may be asked to approve the proposed alteration, measurements, design, or finished result before the work is completed.
Once you have approved a design, measurement, or alteration, changes requested afterwards may result in additional charges or an adjusted completion date.
We will discuss any significant additional work or charges with you before carrying them out where reasonably possible.

Alteration prices

Alteration prices will depend on the type of garment, fabric, construction, complexity of the work, and the alterations required.
Where the final price cannot reasonably be determined before inspecting the garment, we may provide an estimate or quote.
If additional work becomes necessary after inspection, we will explain the additional work and cost before proceeding where reasonably possible.

Deposits and payments for alteration services

Where a deposit or advance payment is required, this will be communicated to you before the service is booked.
Any deposit or payment will be handled in accordance with applicable consumer law.
A cancellation charge or retained deposit will only be applied where permitted by law and where the relevant term is fair and reasonable.
UK consumer law does not allow businesses simply to rely on unfair cancellation or deposit terms.

Completion times

We will provide an estimated completion date or timeframe where possible.
Completion times may vary depending on the type and complexity of the work, the availability of materials, the number of alterations required, and other circumstances.
If circumstances outside our reasonable control cause a delay, we will communicate this to you where reasonably possible.
If no specific time has been agreed, services are generally required to be carried out within a reasonable time under applicable consumer law.

Collection of altered garments

Where an altered garment is ready for collection, we will contact you using the contact details you provided.
You are responsible for collecting your garment within the agreed timeframe.
If a garment remains uncollected for an extended period, we may contact you to arrange collection.
We will not dispose of or otherwise deal with an uncollected garment in a way that removes your rights without giving appropriate notice and acting in accordance with applicable law.

Returns and cancellations

Your rights to cancel an order depend on the type of product or service purchased.
For standard products purchased online, consumers may generally have cancellation rights under the applicable distance-selling rules, subject to legal exceptions.
Certain customised or bespoke products may be exempt from the usual change-of-mind cancellation rights where they have been made to the customer's specifications or clearly personalised.
Alteration services may also be subject to specific cancellation rules, particularly where you have requested that work begins before the usual cancellation period has expired.
Where a legal cancellation right applies, Kateri Studios will honour that right in accordance with applicable law.
We will provide any information required about cancellation rights and applicable exceptions at the relevant stage of your purchase or booking.

Faulty or incorrect products and services

If you believe that a product is faulty, damaged, not as described, or does not meet the requirements of your order, please contact us as soon as reasonably possible.
If an alteration service has not been carried out with reasonable care and skill or does not meet what was agreed, please contact us so that we can discuss the issue and the appropriate remedy.
Your statutory consumer rights are not affected by these Terms & Conditions.

Limitation of liability

Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited.
In particular, nothing in these Terms affects your statutory consumer rights.
Where permitted by law, Kateri Studios will not be responsible for losses that could not reasonably have been anticipated or that arise from circumstances outside our reasonable control.

Events outside our control

Kateri Studios will not be responsible for delays or failure to provide products or services where this is caused by circumstances outside our reasonable control.
This may include events such as serious illness, natural disasters, significant supply problems, interruption to utilities, transport disruption, or other circumstances that could not reasonably have been prevented.
Where such an event occurs, we will make reasonable efforts to communicate with affected customers.

Changes to these Terms

Kateri Studios may update these Terms & Conditions from time to time to reflect changes to our business, products, services, or legal requirements.
The most recent version will be published on this page.
Any changes will apply from the date they are published and will not retrospectively remove rights that you have already acquired.

Governing law

These Terms & Conditions are governed by the applicable laws of the United Kingdom and the relevant jurisdiction in which you are based.
Where applicable, disputes will be dealt with by the courts having appropriate jurisdiction.
